HKR is ripping us off

HKR (Hong Kong Resorts company) is a typical HK property developer which, though listed on the HK stock exchange, is controlled by a single family, in this case the Cha family, which is lead by its 91 year old patriarch, Dr. Cha.

The Chas are a typical property business family in HK, wielding political as well as economic power. Dr Cha is well-connected on the mainland as he is a CCPPC member.

HKR is the owner and operator of Discovery Bay. Through their various subsidiaries, such as the transport company and commercial leasing, they make money from the operations of the community, and of course from the sale of new flats in the new "phases" that are built regularly.

We are not sure about the longterm return on equity that HKR delivers to its minority shareholders, but based on the inconsideration shown to their minority shareholders and stakeholders in DB itself (that is, the small owners, tenants and resident owners,) I would bet they manipulate the company and trample on minority shareholder rights as well. This is common practice in these typical family-run listed companies in HK. Caveat Emptor; invest at your peril.

HKR has run DB as it has pleased for years. According to our experience they dominate the Owner's Committees to ensure that whatever they wish is implemented, and they feel confident that they can do so without significant repercussions.

Their attitude is that with so many "short-termed" expat residents, and with so many owners being non-resident investors, and with most local resident-owners residing in newer phases, that there is no one who can, or will, rock the boat by protesting too loudly or forming any opposition group to their building plans.

As long as they don't threaten the steady rental income from the new crop of expat families moving here every year, few of the current owners will complain too loudly for the sake of either their tenants or themselves.

When an person buys a flat in DB they have to sign their rights away. DB is allowed to make an extensive renovation every 7 years and these are funded mostly by the owners, with only a small amount coming from a residual fund.

Now that real estate values have recovered somewhat, HKR wants to rush through several new phases and extensive renovations in order to increase their profit margins on sales of flats.

This is good for HKR and speculators, but not as much for other owners, and even less for tenants. But since so many residents in the older phases are expat families that leave within 1-3 years, HKR is not concerned about the immediate impact of renovations, as this group has no power or voice within the HK community.

In the last 6 years we have had Siena building, external renovations on several phases, the renovation of the residents Club and of course, our personal favorite (not!) in demonstrating the greed and incompetence of the company: the Plaza renovation.

Everyone in DB knows the stupidity associated with the Plaza renovation: the jagged tiles, the noise, the massive disruption, the loss of our restaurants and lifestyle for almost a year. I think most people have figured out that this renovation was mainly to increase HKR's commercial leasing revenues, primarily from new restaurants, as the economy picks up. "C With an E" and Jaspa's restaurants proved to HKR that upscale western restaurants could work here. Our prediction is that with the re-opening of the plaza and the subsequent large numbers of new commercial units, there will soon be more new restaurants than the community can support, each paying high rents, and within 2-3 years many will close only to be replaced by low-quality, local "kitchen"-type places. This is what occurred in the 90's, when there was little western food available, and 'local' places were of low quality.

The economic value of the Plaza renovation to HKR is obvious, but it would be interesting to know the extent of what HKR gains from the Beach Village renovation.

Anyway, we are pretty sure that THEY are benefiting while we are paying the price, and we know THAT is a rip-off.

This is incredible! How the heck can they get away with this kind of thing? I thought HK had laws that protect tenants and residents. This is like reading something out of the 1800's.It's like the "keystone Cops" become developers.

The government should look into this. HKR got some kind of preferential treatment years ago on the land. There is something fishy about the way that DB has come about I think

For all tenants who do not work and do not have the luxury of escaping the construction noise, blame your landlord who did not tell you of the renovation works beforehand. Ask for refund of rent. All landlords and occupants have known the renovation works months before. Lots of pity for those newly move-ins who have no knowledge at all. HKR has a right under the deed of mutual covenant to renovate its residential development once every seven years. Each time the renovation was approved by owners' committees. How the renovation works are actually managed is a different thing. Agree that lots of improvements and communications to residents are to be desired.

Back in 2001 there was a flat being renovated under us in Caperidge. I fought and fought for DB Mgmt to stop the workers at 6PM. Every day it was the same problem. 6PM would come, and the workers would still be blasting away. Finally, the last day, the European owner of the flat came upstairs and asked us if we would mind if the workers continued until 7PM, because they needed to finish something. THE LAST DAY!
The work permit given by HKR for the work being done also expired several times, but was always renewed with no thought about the continued noise and stress inflicted on other residents.
I took pictures of the workers as they came out one evening, and almost got into a knife fight with one. It seems that illegals are often used in DB renovations in order to save money.
We left in the summer of 2002 and regret leaving behind friends, but not DB Mgmt or HKR.

I have a suggestion. Everyone chill!! I'm an expat resident AND an owner so I'm paying serious bucks for this mess. Am I pissed off? You bet your ass I am!! Lets not get hysterical though. Women and young girls in danger of rape?? Give me a break!!! This is Hong Kong. When was the last crime that serious committed against an expat by a local?? 198? at Braemar Hill(sp?). So lets not get hysterical.
Lets be reasonable with reasonable arguments and we are sure to be paid more attention than if our arguments are unfounded, speculative and unreasonable.
Do I think we have a case? My word we do!! I have damage to almost every part of my outside living space. HKR pass the buck to the contractor and the contractor wont return my dozen (or more) calls. Is the previous writer correct about peeing under our buildings? He sure is. A guy pee'd on my kayak down there. However.... if you were them...where would you go?? There are no provisions for them. OK..so you'd quit before doing that?...Sure. But bear in mind..if they were rocket scientists they'd be doing rocket science. Just like every country in our precious "developed world"......Wake up call. It doesn't matter where your from ther are people who would resort to peeing under your building given no choice. In fact, if you are a westerner (as I am) I dare say given the opportunity there would be people in the very city your from who would pee on you, scratch the paintwork of your new car, vandalise your property and chastise everything you stand for just because you make a descent crust.
For the record I went to every owners committee meeting I could in the runnup to these reno's. I tried to make a difference. In fact I tried to get much more done than is being implemented now.
Did I fail?... Sure. But I tried.
In the end the owners voted for the cheapest possible option by the cheapest contractor who was, incidentally, already being sued by another
village owners committee in DB. As my Canadian friends would say.. "Go Figure"
My closing statement.
HKR buid crap quality.
Try going to Caribean coast in Tung Chung and comparing to the likes of Sienna hi-rise. Not even close my friend. HKR do things on the cheap. Always have, always will. I have a million examples but I'll leave you with just one.
There are small "star lights" placed under the new stone paving in the plaza?....At what cost? oh about HKD 2 Million. How many of them do you think will work??.. Answer. Minimal if any...probably none. The reason?? They skimped and used a contractor who under quoted everyone else. Result?... the fibre optic cable was laid directly under the stones without laying it through (conduit) tubing and the stones were then tapped into position on top of it. The lights are laid in the gaps between the dark stones. look for yourself. $2 Million worth of all your management fees just up in smoke. And thats only one example.
Conclusion.
HKR is the culprit plain and simple. People would do a better job if they paid em more. So that why your houses are in need of massive renovation.
Your absolutely stupid landlords are , however, responsible for voting for the cheapest job possible and hence the mess your in now.

Incidentally...DID YOU KNOW the Chairlady of the Beach VOC is also chairlady for 3 other villages in DB?Can she really look after all your best interests AND those of 2 other villages AND hold a full time job?
....... AND ( I thought this was DISGUSTING!!) did you know there are MORE than several members of your village owners committe, who make decisions on your behalf regularly,who own a place in Beach village..... and rent it out. They don't even live in DB. Its not a requirement.They live in town.

I think it is a big mistake that the chairlady runs other villages. As far as I know, she lives in Beach and she only represents Beach.
